2. Purposes of data processing, legal bases and legitimate interests, storage period
2.1 Personal data
Personal data within the meaning of the GDPR and the BDSG (German Federal Data Protection Act) is information about the factual or personal circumstances of a specific or identifiable natural person. The personal data of users processed within the scope of this online service includes, in particular:
- your name, address, date of birth, email address, and telephone number, your username and encrypted password for your customer account,
- the products you have purchased, the services you have used, payment information (e.g., bank details, payment history),
- your data collected when using our website and our online services.
2.2 Purposes of processing
2.3 Legal basis for the processing of your personal data
Below, we inform you of the legal basis for the data processing we carry out in accordance with Art. 13 GDPR. If the legal basis is not specifically stated in the privacy policy, processing is carried out for one or more of the following purposes based on the respective statutory provisions:
- Fulfillment of our services (in particular for contract processing) or for the implementation of pre-contractual measures at your request (Art. 6 (1) (b) GDPR),
- Fulfillment of a legal obligation to which we are subject (Art. 6 (1) (c) GDPR),
Protection of our legitimate interests or the legitimate interests of a third party (Art. 6 (1) (f) GDPR), or, if you have given us your consent to do so, on the basis of this consent (Art. 6 (1) (a) and Art. 7 (f) GDPR).
2.4 Sharing your data
In order to process your request and your orders, it may be necessary to share your personal data with third parties, including those outside the EU or the European Economic Area (EEA).
We will share your data in the following cases and on the basis of the respective statutory permission:
- if the transfer of data to third parties or to companies affiliated with us is necessary for the performance of the contract in accordance with Art. 6 (1) (b) GDPR; this includes, for example, data transfers to payment service providers, transporters, logistics providers, and suppliers if they supply you directly,
- you have consented to the transfer of your data (Art. 6 (1) (a) GDPR),
- based on our legitimate interest or the legitimate interest of a third party (Art. 6 (1) (f) GDPR); this includes, for example, data transfers within the framework of assignment of claims or to credit agencies for the purpose of credit checks and to marketing partners,
- if the transfer is necessary to fulfill a legal obligation to which we are subject (Art. 6 (1) (c) GDPR).
Any third parties to whom we share your personal data may only use this data for the purposes stated above. Furthermore, they are obligated to process the data only in accordance with our instructions and applicable data protection laws.
We sometimes use external service providers to process your data. These service providers have been carefully selected and commissioned by us and are bound by our instructions. Furthermore, we are contractually authorized to monitor their compliance with the relevant contractual and legal regulations. The external service providers can be assigned to the following categories:
- Service providers for hosting, maintaining, and servicing our website,
- Service providers in the area of order processing, in particular providers of logistics services,
- Service providers in the area of customer service,
- Banks and other providers of payment services, including for processing payments,
- Shipping providers for email newsletters and shipping providers for catalogs or other direct mail,
- Service providers in the area of marketing and web analytics.
If we transfer personal data to recipients in so-called "third countries," i.e., countries outside the EU or EEA where a level of data protection comparable to that in the EU cannot be readily assumed, and we are not authorized to transfer data due to a legal obligation, we ensure that the required appropriate level of data protection is guaranteed in the respective third country or at the recipient in the third country. This may result, in particular, from a so-called "adequacy decision" of the European Commission, which determines an adequate level of data protection for a specific third country as a whole. Alternatively, we may base the data transfer on the so-called "EU Standard Contractual Clauses" agreed with a recipient or - in the case of recipients in the USA - on compliance with the principles of the so-called "EU-US Privacy Shield."
2.5 Storage period and deletion of your personal data
We generally only store your data for as long as necessary for the respective processing purpose. We store the data collected for the purpose of contract processing until the expiration of the statutory or possible contractual warranty and guarantee rights. After this period, we retain the information required by commercial and tax law relating to the contractual relationship for the legally specified periods. During this period (usually ten years from the conclusion of the contract), the data will only be processed again in the event of an audit by the tax authorities. Regarding other purposes pursued by us, please refer to the following provisions for the storage period.
3. Data processing to set up a customer account
We set up password-protected access to the inventory data stored with us (customer account) for every customer who registers on our website. Here, you can view information about your orders and manage your address, bank details, newsletter, and other settings. With the "Stay logged in" function, we want to make your visit to our website as pleasant as possible. This function allows you to use our services without having to log in each time. For security reasons, however, you will be asked to enter your password again if, for example, you want to change your personal data or place an order. We recommend that you do not use the "Stay logged in" function if the computer is used by multiple users. We would also like to point out that the "Stay logged in" function is not available if you use a setting that automatically deletes stored cookies after each session.
We use the data collected when you open a customer account to process orders, provide additional services you have requested, and offer payment options and process payments and any refunds. The legal basis for processing personal data in connection with setting up a customer account is Art. 6 (1) (b) GDPR.
We will delete the data collected and stored in connection with your customer account at the latest when you delete your customer account yourself or you notify us that you wish to delete your customer account. However, premature deletion of your personal data is not possible if and to the extent that the data is still required for contract processing or if legal regulations require us to retain it for longer periods.
4. Data processing to process your order
If you purchase products from our online shop, we need your name, address and payment details, your email address, and a telephone number to process your order so we can communicate with you. We also use the email address for your identification (customer login). You will also receive your order and shipping confirmations via your email address. We process your data to process your orders, including any subsequent returns and warranty claims. The legal basis for this is Art. 6 (1) (b) GDPR (contractual fulfillment).
4.1 Data transfer to shipping service providers
If you have given us your express consent to do so during or after your order, we will pass on your email address and telephone number to the selected shipping service provider in accordance with Art. 6 (1) (a) GDPR so that they can contact you before delivery for the purpose of notifying you of the delivery or coordinating the delivery.
You can revoke your consent at any time by sending a message to the contact option described below or directly to the shipping service provider at the contact address listed below. After revocation, we will delete the data you provided for this purpose unless you have expressly consented to further use of your data or we reserve the right to use your data in any other way that is permitted by law and about which we will inform you in this declaration.

Further information on Stripe’s privacy policy can be found here https://stripe.com/de/privacy#translation.
5. Data processing for contacting us and for customer support
There are various ways to contact us. You can reach our customer service by phone or email. We also provide a contact form on our website. In this context, we collect your name, email address, telephone number, customer, order, and item number, as well as any other information you provide to us.
We use the data you provide when you contact us exclusively for the purpose of answering your inquiry. The legal basis for this is Art. 6 (1) (b) and (f) GDPR (performance of the contract and legitimate interest in processing inquiries and other concerns). Your data will be deleted after your inquiry has been processed, unless further storage is necessary to properly respond to your inquiry (e.g., to process a customer complaint in the context of an order; see Section 4 (Data processing to process your order) above).
6. Collection, processing and use of your personal data for advertising purposes
In addition to processing your data to set up a customer account, to process your orders with us and to handle your inquiries and other requests, we also use your data in accordance with the following sections to communicate with you about your orders, certain products or marketing campaigns and to recommend products or services that may be of interest to you.
6.1 Newsletter
You can sign up to receive our newsletter on our website. The LUNAPOLIS newsletter contains news, offers, and other information about LUNAPOLIS products and services. Our newsletter is sent based on your consent in accordance with Art. 6 (1) (a) GDPR. To receive the newsletter, you must enter your email address in the field provided on our website. We will then send you a notification email and ask you to confirm that you wish to receive our newsletter by clicking on a link contained in this email (double opt-in). We will therefore only send you a newsletter by email if you have previously expressly confirmed that we should activate the newsletter service.
You can revoke your consent to the processing of your data for the purpose of sending the newsletter at any time with future effect. To do so, simply send a short email to the email address provided under Section 10. Furthermore, you will find an unsubscribe link in every newsletter. Your data will be stored for the purpose of sending the newsletter as long as you are subscribed to the newsletter.
6.2 Product recommendations by email
If you have concluded a contract with us, we will process your email address without specific consent in order to regularly send you product recommendations by email. In this way, we want to send you information about products from our range that might be of interest to you based on your recent purchases with us. The legal basis for the aforementioned processing is Art. 6 (1) (f) GDPR in conjunction with Section 7 (3) UWG (German Unfair Competition Act), as the processing of existing customer data for advertising purposes represents a legitimate interest. You can object to the processing of your data for the purpose of sending product recommendations by email at any time. All you need to do is send a short email to the email address provided under Section 10. You will also find an unsubscribe link in every email with product recommendations.
6.3 Catalogue dispatch
If you have entered into a contract with us, we may process your postal contact details without specific consent in order to send you our current product catalog or other direct mail. The legal basis for this is Art. 6 (1) (f) GDPR. The processing of existing customer data for advertising purposes is considered a legitimate interest.
6.4 Participation in competitions, promotions and surveys
When you participate in LUNAPOLIS sweepstakes, promotions, and surveys, we collect the data necessary to conduct the respective sweepstakes, promotions, or surveys. In the case of sweepstakes, we also use the personal data we receive from you in this context for the purpose of notifying you of your winnings. For sweepstakes and promotions, you will generally find detailed information on data protection in the terms and conditions for the respective sweepstakes or promotion. The data collected in this context will only be stored for as long as necessary to conduct the respective sweepstakes or promotion. After that, it will be deleted.
If you participate in a LUNAPOLIS survey, we will process your data exclusively for internal purposes and to improve our services and offerings. The personal data you provide as part of the survey (name, email address, and your survey responses) is provided entirely voluntarily, and you can still use LUNAPOLIS's offerings even if you do not participate in surveys. Any publication of survey results will only be done anonymously.
We store your data processed in this context for as long as we need it to fulfill the aforementioned processing purpose. The legal basis for the aforementioned data processing is Art. 6 (1) (f) GDPR (legitimate interest).
6.5 Right of objection
You can object to the use of your data for advertising purposes at any time, free of charge, separately for each communication channel, and with future effect. To do so, simply send a written notification (email, letter) to the contact details listed under Section 10.
7. Cookies
We use cookies on our website. We do this on the basis of Art. 6 (1) (f) GDPR (legitimate interest in the analysis, optimization and economic operation of our online offering). Cookies are small files that are stored on your device and that save certain settings and data for exchange with our system via your browser. Basically, a distinction is made between two different types of cookies: so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your device for a longer period of time or indefinitely. This storage helps us to tailor our website and our offerings to suit you and makes it easier for you to use, for example by saving certain entries you make so that you do not have to repeat them constantly.
Which cookies does LUNAPOLIS use?
Most of the cookies we use are automatically deleted from your device at the end of the browser session (hence session cookies). Session cookies are required, for example, to offer you the shopping cart function across multiple pages. We also use cookies that remain on your device. On your next visit, it is automatically recognized that you have already visited us and which entries and settings you prefer. These temporary or permanent cookies (lifetime 1 month to 10 years) are stored on your device and delete themselves automatically after the specified time. These cookies in particular serve to make our offering more user-friendly, effective and secure. Thanks to these files, it is possible, for example, to display information on the website that is specifically tailored to your interests.
Onsite Targeting
The LUNAPOLIS website uses cookie technology to collect data to optimize our advertising and the entire online offering. This data is not used to identify you personally, but is solely used for a pseudonymous evaluation of website usage. This technology allows us to present you with advertising and/or special offers and services whose content is based on the information obtained through clickstream analysis. Our goal is to make our online offering as attractive as possible for you and to present you with advertising that matches your areas of interest.
Third-party cookies
LUNAPOLIS uses the services of advertising partners to help make the internet offering and the website more interesting for you. Therefore, when you visit the LUNAPOLIS website, cookies from partner companies are also stored on your device. These are temporary/permanent cookies that are automatically deleted after a specified period of time (lifespan: 1 month to 10 years). These cookies collect data pseudonymously under a user ID. This includes, for example, data about which products you have viewed, whether something was purchased, which products were searched for, etc. Some of our advertising partners also collect information beyond the website itself, such as which websites you have previously visited or which products you were interested in, for example, in order to show you advertising that best matches your interests.
If you do not want third-party cookies to be stored on your computer, you can change your browser settings as described below (under Changing Your Cookie Settings) to generally prevent cookies from being set. Third-party providers also offer the option of objecting to the setting of your cookies and provide opt-out settings on their websites. Further information can be found below in the respective service descriptions.
Google AdWords
We use Google Conversion Tracking (visit action analysis) Google AdWords from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google AdWords). Google AdWords places a cookie on your computer if you have reached our website via a Google ad. These cookies expire after 30 days and are not used for personal identification. If you visit a specific page on the AdWords customer's website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. Each AdWords customer receives a different cookie. Cookies cannot therefore be tracked across the AdWords customer's websites. The information collected using the conversion cookie is used to compile conversion statistics for us. This tells us the total number of users who clicked on our ad and were redirected to a page with a conversion tracking tag. We do not receive any information that can be used to personally identify users.
Further information on Google's use of data, settings and objection options can be found on Google's websites: https://policies.google.com/technologies/partner-sites?hl=de ("How Google uses data when you use our partners' websites or apps"), http://www.google.com/policies/technologies/ads ("How Google uses data for advertising purposes"), http://www.google.de/settings/ads ("Manage information that Google uses to show you ads").
Bing Ads
We use conversion tracking (visit action analysis) from Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA (Microsoft Bing Ads). This service collects and stores data on our website from which user profiles are created using pseudonyms. This service enables us to track the activities of users on our website if they have reached our website via Bing Ads ads. Microsoft Bing Ads places a cookie on your computer if you have reached our website via a Microsoft Bing ad. This allows us and Microsoft to recognize that someone has clicked on our ad and been redirected to our website and visited a previously defined landing page. We only learn the total number of users who clicked on a Bing ad and were then redirected. The information collected is transferred to Microsoft servers in the USA and stored there for a maximum of 180 days. In addition, Microsoft may track your usage behavior across multiple electronic devices through so-called cross-device tracking, enabling it to display personalized advertising on or in Microsoft websites and apps. Microsoft is certified under the Privacy Shield Framework, thus guaranteeing compliance with European data protection law.
If you do not wish to participate in Bing Ads' tracking process, you can deactivate this behavior at http://choice.microsoft.com/de-de/opt-out. Further information on Bing's analytics services can be found on the Bing Ads website (https://help.bingads.microsoft.com/#apex/3/de/53056/2). Further information on data protection and the cookies used by Microsoft Bing Ads can be found in the Microsoft privacy policy (https://privacy.microsoft.com/de-de/privacystatement).
Retargeting
We also use so-called retargeting technologies on our website. We use these technologies to make the internet offering more interesting for you. This technology makes it possible to target internet users who have already shown an interest in our online shop and our products with advertising on our partners' websites. We are convinced that the display of personalized, interest-based advertising is generally more interesting for internet users than advertising that has no such personal relevance. The display of these advertisements on our partners' websites is based on cookie technology and an analysis of previous usage behavior. This form of advertising is completely pseudonymous. If you do not want these cookies to be stored on your computer, you can change your browser settings as described below (under Changing your cookie settings) so that the setting of cookies is generally prevented. In addition, the providers of retargeting technologies also offer the option of objecting to the setting of your cookies and offer opt-out settings on their websites. Further information can be found below in the respective descriptions of the services.
Facebook Pixel
We use the visitor action pixel from Facebook, Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (Facebook Pixel) to evaluate and support online marketing measures. This allows us to track the actions of users after they have seen or clicked on a Facebook ad. For this purpose, cookies may be stored on your computer. This allows us to record the relevance of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us, and personal data of individual users is not visible to us. However, this data is stored and processed by Facebook. Facebook can link this data to your Facebook account and also use it for its own advertising purposes, in accordance with Facebook's data usage policy: (https://www.facebook.com/about/privacy/update?ref=old_policy). The Facebook Pixel can be deactivated via the following link by changing the "Facebook ad settings": http://facebook.com/ads/settings.
Web analysis
In order to continuously improve and optimize our offering, we use the web analysis tools listed below. These tools also use cookies. You can prevent the storage of these cookies at any time by changing your browser settings as described below (under "Changing your cookie settings"), so that the setting of cookies is generally prevented. In addition, the providers of the web analysis tools also offer the option of objecting to the setting of your cookies and offer opt-out settings on their websites. Further information can be found below in the respective service descriptions.
Google Analytics
Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google Analytics). Google Analytics uses cookies that enable Google to analyze how users use our website. The information collected by the cookies about your use of the website (including your anonymized IP address) is usually transferred to a Google server in the USA and stored there. Google is certified under the Privacy Shield Agreement and thus offers a guarantee of compliance with European data protection law. Google uses this information to evaluate your use of our website, to compile reports on website activity for us, and to provide us with other services relating to website activity and the Internet. We would like to point out that Google Analytics has been enhanced on our website to ensure anonymous collection of IP addresses (so-called IP masking). Google will only record your IP address in abbreviated form, which ensures anonymity and prevents any conclusions about your identity. When IP anonymization is activated on our website, Google will first shorten your IP address within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
You can prevent the collection of data generated by cookies and related to your use of this website (including your IP address) as well as the processing of this data by Google by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=de. Further information on Google Analytics Terms of Use and Privacy Policy can be found at https://www.google.com/analytics/terms/de.html and at https://support.google.com/analytics/topic/2919631?hl=de&ref_topic=1008008.
DoubleClick by Google
DoubleClick by Google is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google DoubleClick). Google DoubleClick uses cookies to show you ads that are relevant to you. A pseudonymous identification number (ID) is assigned to your browser to check which ads are displayed in your browser and which ads have been viewed. The cookies do not contain any personal information. The use of DoubleClick cookies merely enables Google and its partner websites to display ads based on previous visits to our or other websites on the Internet. The information generated by the cookies is transferred by Google to a server in the USA for evaluation and stored there. Google is certified under the Privacy Shield Agreement and thus offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
You can prevent Google from collecting the data generated by the cookie and relating to your use of the website, as well as from processing this data, by downloading and installing the browser add-on available under the following link: https://tools.google.com/dlpage/gaoptout?hl=de. You can also deactivate Google's use of cookies by visiting http://www.google.com/privacy/ads and clicking the opt-out button. Further information on Google DoubleClick and Google's privacy policy can be found at http://www.google.com/intl/de/privacy/.

You can adjust your cookie settings at any time. You can set your internet browser to generally prevent cookies from being saved on your device or to ask you each time whether you agree to cookies being set. You can also delete cookies once they have been set at any time. You can find out how to do this in detail in your browser's help function. Accepting cookies is not a requirement for visiting our website. However, we would like to point out that using the shopping cart function and ordering products is only possible if you allow us to set cookies. Generally deactivating cookies may result in functional limitations on our website.
8. Secure data transmission and data security
Your personal data is transmitted securely using encryption. This applies to your order and your customer login. We use the SSL (Secure Socket Layer) encryption system. Furthermore, we protect our website and other systems through technical and organizational measures against loss, destruction, access, alteration, or distribution of your data by unauthorized persons.

If the processing is carried out for direct marketing purposes, you can exercise this right at any time as described above. If the processing is carried out for other purposes, you only have the right to object if there are reasons arising from your particular situation.
After exercising your right of objection, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or if the processing serves to assert, exercise, or defend legal claims.
